Alleged beer thief wields knife at deputy
A Shell Knob man is facing two felonies after allegedly breaking into a Shell Knob business, stealing alcohol, then pulling a weapon on a Barry County deputy before being tased, fleeing, and ultimately detained.
Levi Kelley, born 1987, of Shell Knob, is charged with second-degree burglary and resisting arrest.
According to a probable cause statement filed by Tanner Hightower and Cedrick Calderon, deputies with the Barry County Sheriff’s Office, at 5:56 a.m. on Aug. 16, Hightower observed on the Shell Knob Dollar General’s security footage a man, wearing the same clothes and with the same physical description as Kelley, throwing a rock through the front right sliding glass door at about 2:49 a.m. Kelley allegedly entered through the broken window, grabbed a case of Budweiser beer and a can of Nos energy drink, leaving 1 minute after entering.
Calderon later made contact with Kelley, who was wearing the same clothes as in the security footage, on Highway 39 in Shell Knob. Hightower then made contact and positively identified Kelley per the video.
Calderon informed Kelley he was under arrest and to turn around and put his hands behind his back. Kelley allegedly put his hands behind his back but continued facing Calderon, then allegedly made a comment he was with the Hell’s Angels and reached into his front right pocket with his right hand and grabbed his knife.
Calderon deployed his taser on Kelley, who allegedly pulled out the prongs and fled on foot.
Calderon said he gave Kelley commands to stop, and Kelley did not. Calderon said he then caught Kelley and placed him into custody.
The probable cause statement notes Kelley has prior offenses from April 2019 of tampering with a motor vehicle, stealing a firearm, violating an order of protection and fourth-degree domestic assault.
Kelley is being held in the Barry County jail on a cash-only bond of $50,000. A bond hearing was held on Monday in the courtroom of Judge Robert Foulke.
