Victim in case mentally challenged

A Cassville man has been charged with first-degree sodomy for alleged acts involving a victim that is mentally challenged.

James Weathers, 63, of Cassville, is being held in the Barry County jail on a cash-only bond of $50,000.

According to a probable cause statement filed by Det. Danny Boyd, with the Cassville Police Department, Weathers had the victims stay the night at his residence on several occasions, and Weathers allegedly committed sex acts on the victim multiple times.

Boyd said the victim is mentally challenged and unable to consent, and Weathers is aware of the condition.

Weathers had an initial appearance scheduled for Tuesday in the courtroom of Judge Robert Foulke.
