Man allegedly spit on, kicked officer during arrest
A Cassville man is facing three felonies after allegedly breaking into a victim's home and spitting on and kicking a police officer during his arrest.
Robert Danley, 44, of Cassville, is charged with first-degree burglary, third-degree assault, resisting arrest and misdemeanor property damage.
According to a probable cause statement filed by Kenen Martinez, Exeter police chief, on Nov. 29 at about 3:37 a.m. Danley broke into the victim's home on Washburn Street in Exeter, climbing through a kitchen window.
Danley had allegedly been told not to contact the victim for the purpose of causing emotional distress.
After Martinez arrived on the scene and told Danley he was under arrest, Danley allegedly spat on Martinez, and when taken to the ground, Danley allegedly kicked Martinez in the leg.
At the time of the incident, Danley also had an outstanding warrant in Newton County for a probation violation.
Danley is being held in the Barry County jail on a cash-only bond of $50,000. He has been arraigned, and a disposition hearing was held Tuesday in the courtroom of Judge Robert Foulke.
