Eagle Rock man accused of assaulting deputy
27-year-old allegedly kicks, hits, spits at deputy
The Barry County Prosecutor's Office has charged an Eagle Rock man with second-degree assault of a law enforcement officer.
Jamie McCarty, 27, allegedly resisted arrest by kicking Barry County Deputy Mike Moore at about 4:11 p.m. Feb. 15, according to a probable cause statement filed by Moore.
After McCarty was placed in custody, he allegedly continued to kick, striking the deputy in the chest twice, causing pain and discomfort for approximately 20 minutes.
At the Barry County Jail, McCarty allegedly attempted to spit in Moore's face, according to the statement. When Moore turned McCarty's head away, McCarty allegedly struck the deputy's left side with his fist.
The assault charge is a Class C felony, which carries a maximum of seven years in prison and a $5,000 fine.
McCarty has a disposition hearing at 9 a.m. March 12 in the Barry County Judicial Center with Judge Robert Foulke.
McCarty remains in the county jail with a bond set at $15,000.
